This document explains the basic rules for using your GoHighLevel (GHL) account provided by Kreativ Insight Consultants Inc. through the Canada Growth Network.

This document will cover the following:

  • What you’re getting access to

  • What you are responsible for

  • How billing and usage charges work

  • What is and isn’t allowed on the platform

  • How support, AI tools, and third-party access are handled

By starting a trial or using this service, you are agreeing to these terms. They are in place to protect both you and us and to ensure the platform is used responsibly and legally.

If anything in this document is unclear, please ask before using the system. We’re here to help you use the platform with confidence.

1. Overview

These Terms & Conditions (“Agreement”) govern the Client’s use of the GoHighLevel (“GHL”) sub-account provided by Kreativ Insight Consultants Inc. (“Kreativ Insight”, “we”, “us”, “our”).


Canada Growth Network (“CGN”) acts solely as a promotional and community brand under Kreativ Insight.

 

By activating your account, the Client agrees to these Terms.

2. Service Description

Kreativ Insight provides:

  • A GHL SaaS sub-account under our agency umbrella

  • Basic technical setup (account creation only)

  • Access to the software platform, CRM, funnels, email/SMS tools, automations, calendars, and related features provided by GHL

Kreativ Insight provides:

  • Software access only

  • No done-for-you services unless purchased separately

Optional paid services include:

  • Setup support

  • Funnels

  • Automations

  • Analytics

  • AI workflows

  • Campaign building

  • Troubleshooting

3. Client Responsibilities

The Client is fully responsible for:

3.1 Legal and compliant data collection

The Client must collect, store, and manage all data in compliance with:

  • PIPEDA (Canada)

  • CASL (Canadian Anti-Spam Law)

  • Any applicable privacy laws in the Client’s region

Kreativ Insight Consultants Inc. and Canada Growth Network (CGN) do not control, approve, or monitor your messaging, data collection, or outreach activities. We are not responsible for how you use the platform.

3.2 Ethical messaging

All email, SMS, calls, and outreach must be consensual, legal, and properly permission-based.

3.3 Wallet charges

Your GoHighLevel account uses a prepaid Wallet to pay for specific features that are charged based on usage. This includes, but is not limited to:

  • SMS and MMS messages

  • Phone calls and call recordings

  • Email sending

  • AI tools and AI-powered features

  • Other metered or pay-per-use services offered by the platform

The Client must:

  • Maintain a funded wallet for SMS, emails, calls, recordings, AI usage, and metered features

  • Understand that if the wallet is depleted, automations will fail

  • Accept that wallet usage fees are non-refundable

3.4 Technical assets

The Client is responsible for providing the following:

  • Domain(s)

  • DNS access

  • Email addresses

  • Twilio number(s)

  • Verified sending domains (SPF/DKIM/DMARC

Kreativ support can assist but is not liable for deliverability, DNS failure, downtime, or transmission issues on a fee-for-service basis.

4. Trial Periods

Kreativ Insight may offer a limited trial from time to time to allow Clients to explore the GoHighLevel platform before starting a paid subscription.

Purpose of the Trial

The trial is provided for evaluation and learning purposes only. It is intended to help you understand the features and determine whether the platform is a good fit for your business.

Restrictions During the Trial

To protect the platform, service providers, and all users, the following activities are not permitted during the trial period:

  • During the trial period, any mass or bulk email activity must be strictly limited to no more than forty (40) emails per hour, assuming one(1) campaign per week, for the first four (4) weeks. This limitation is required to warm up sending domains and email accounts properly and to reduce the risk of spam complaints, blacklisting, or account flagging. Failure to follow these limits may be treated as trial abuse and may result in immediate suspension or termination of trial access.

  • Importing contact lists over 500 contacts (or an agreed amount specified at the time of trial)

  • Cold outreach or non-consensual messaging

  • Automated SMS or call campaigns

  • Use by or promotion of high-risk or prohibited industries, including but not limited to:

    • Cryptocurrency

    • Adult content

    • Payday lending

    • Gambling

  • Any activity that may result in spam complaints, deliverability issues, or platform abuse

Monitoring and Enforcement

Kreativ Insight reserves the right to:

  • Monitor usage for trial compliance

  • Suspend or terminate trial access immediately if misuse or abuse is detected

  • Deny conversion to a subscription service plan if the trial is abused

No Guarantees or Refunds

  • Trial access is provided “as-is” with no guarantees of performance, deliverability, or results

  • Trial fees are non-refundable

  • Abuse of the trial results in immediate termination without notice

5. Pricing & Adjustments

The Client agrees to pay the applicable monthly subscription fee for access to the GoHighLevel sub-account on a month-to-month basis, unless otherwise stated in writing.

Pricing Changes

  • Subscription pricing may be adjusted if GoHighLevel increases its wholesale or platform pricing

  • Any increase will be applied proportionally and reflected in future billing cycles

  • Continued use of the service after a pricing change constitutes acceptance of the updated rate

  • Reasonable notice  (minimum of 3 days)of any pricing increase will be provided in advance by email or in writing before the new rate takes effect

Usage-Based Charges

  • Certain features are billed based on usage, including but not limited to SMS, calls, email sending, AI tools, and other metered services

  • Usage-based fees are charged through the Wallet and billed directly to the payment method on file (See section 3.3 for more information)

Refund Policy

  • All subscription fees are non-refundable, except in cases of duplicate charges or confirmed billing errors

  • Wallet usage charges are non-refundable under all circumstances

  • Any refunds, credits, or billing adjustments are issued solely at the discretion of Kreativ Insight Consultants Inc. and Canada Growth Network (CGN)

6. Kreativ Insight Access to Client Accounts

By default, Kreativ Insight Consultants Inc. or Canada Growth Network personnel or agents do not access Client accounts without explicit permission.

Permission Requirement

  • Client permission must be granted in writing by email before Kreativ Insight accesses the account for any work

  • Permission applies only to the specific tasks approved by the Client

  • Each GoHighLevel sub-account includes access for up to five (5) total users, which includes the Client, internal staff, and any third-party users such as virtual assistants, contractors, or agencies, unless otherwise agreed in writing.

  •  The Client is responsible for requesting access and removal when no longer required.

  •  Kreativ Insight Consultants Inc. and Canada Growth Network (CGN) reserve the right to restrict, suspend, or require an upgrade or additional fees for accounts that exceed the allowed user limit.

Permitted Access Activities

Once permission is granted, authorized personnel may access the Client’s account only for the purposes requested, which may include:

  • Initial or follow-up setup

  • Troubleshooting and technical support

  • Workflow and automation building

  • Campaign creation and optimization

  • Funnel creation and updates

  • Marketing support and implementation

  • Analytics, reporting, and performance review

  • AI-related setup, testing, and optimization

  • System configuration and maintenance

Billing & Payment

  • All support, setup, marketing, and technical services are not included in the subscription or Wallet

  • These services are billed separately on an hourly, project, or subscription basis, as agreed in writing

  • Payment is required in advance unless otherwise agreed

Permission Removal

  • The Client may remove or modify access permission at any time by written notice via email

  • Removal of permission does not waive responsibility for:

    • Work already completed

    • Fees already incurred

    • Ongoing issues resulting from prior approved changes

Kreativ Insight and Canada Growth Network will respect all access permissions and limitations as communicated by the Client.

7. Third-Party Access

The Client may choose to grant access to their GoHighLevel account to third-party individuals or service providers, including but not limited to virtual assistants (VAs), contractors, consultants, coaches, agencies, or internal team members.

Client Responsibility

 

By granting third-party access, the Client acknowledges and agrees that:

  • All third-party access is granted at the Client’s sole discretion and risk

  • The Client is fully responsible for:

    • Selecting, vetting, and managing third parties

    • Assigning appropriate user roles and permission levels

    • Monitoring actions taken by third parties within the account

Liability & Risk

Kreativ Insight Consultants Inc. and Canada Growth Network (CGN) are not responsible or liable for:

  • Any changes, deletions, or misconfigurations made by third parties

  • Security breaches, data exposure, or unauthorized use

  • Broken automations, campaigns, workflows, or funnels

  • Deliverability issues caused by third-party actions

  • Compliance violations, including CASL, PIPEDA, or other applicable laws

Any repair, cleanup, troubleshooting, or rebuilding required as a result of third-party actions is billable and not included in the subscription or Wallet.

Best Practices (Client Responsibility)

The Client is strongly encouraged to:

  • Use unique user logins for each third party

  • Limit access to only what is necessary

  • Remove access immediately when no longer required

  • Maintain records of who has access and when

No Oversight Obligation

Kreativ Insight and Canada Growth Network (CGN):

  • Do not supervise or manage third parties

  • Do not audit or review third-party work unless separately contracted

  • Do not guarantee compatibility between third-party work and existing systems

By granting third-party access, the Client accepts full responsibility for all outcomes resulting from that access.

8. Prohibited Use & Immediate Termination

To protect the platform, service providers, and all users, certain activities are strictly prohibited. Kreativ Insight Consultants Inc. and Canada Growth Network (CGN) reserve the right to immediately suspend or terminate access to the Client’s account if prohibited use is detected.

Prohibited Activities

The Client may not use the platform for, or in connection with, any of the following:

  • Illegal activities of any kind

  • Spam, unsolicited messaging, or non-consensual outreach

  • Purchased, scraped, rented, or third-party contact lists

  • Cold email, SMS, or calling without proper consent

  • High-risk or restricted industries, including but not limited to:

    • Cryptocurrency or crypto-related offers

    • Adult content or services

    • Payday lending or high-interest financial products

    • Gambling or betting

  • Harassment, threats, hate speech, or discriminatory content

  • Fraud, deception, impersonation, or false claims

  • Fake reviews, testimonials, or social proof

  • Botting, scraping, or automated abuse

  • Arbitrage campaigns that damage deliverability or platform reputation

  • Attempting to bypass, manipulate, or avoid Wallet usage fees

  • Abuse or misuse of trial access

  • Activity that places Kreativ Insight, Canada Growth Network, GoHighLevel, or service providers at risk

  • Any action that negatively impacts platform reputation, deliverability, or compliance

Enforcement & Termination

  • Prohibited use may result in immediate suspension or termination without prior notice

  • Kreativ Insight or Canada Growth Network is not required to provide warnings or remediation opportunities

  • Termination may occur even if the activity was performed by:

    • A third party

    • A contractor or VA

    • An internal team member

The Client remains fully responsible for all actions taken within their account.

No Refunds Upon Termination

  • No refunds, credits, or Wallet reimbursements will be issued for accounts terminated due to prohibited use

  • Outstanding balances, Wallet charges, or repair costs remain payable

Reporting & Cooperation

Kreativ Insight and Canada Growth Network may:

  • Report prohibited or illegal activity to relevant authorities or service providers

  • Cooperate with investigations where required by law

By using the platform, the Client agrees to comply fully with this Policy.

9. Contacting GoHighLevel (GHL) Support Directly

Your GoHighLevel account is provided as a sub-account under the Kreativ Insight agency structure. Because of this structure, certain actions taken by GoHighLevel (GHL) support can impact your account configuration, billing, and functionality.

Client-Initiated Support Requests

If the Client chooses to contact GHL support directly, the Client acknowledges and agrees that:

  • Kreativ Insight Consultants Inc. and Canada Growth Network (CGN) do not control the actions taken by GHL support

  • GHL support may make changes to account settings, integrations, billing configurations, workflows, or system permissions without consulting Kreativ Insight

  • GHL support may enable, disable, reset, or modify features that affect automations, campaigns, deliverability, or Wallet usage

No Responsibility for Changes or Charges

Kreativ Insight and Canada Growth Network are not responsible for:

  • Any changes made by GHL support

  • Any charges, fees, or usage incurred as a result of GHL support actions

  • Feature resets, broken workflows, disabled automations, or altered configurations

  • Deliverability issues or compliance problems resulting from changes made by GHL support

Repair & Restoration

  • Any troubleshooting, repair, cleanup, or restoration work required as a result of Client-initiated contact with GHL support is not included in the subscription or Wallet

  • Such work is billable separately at applicable hourly or project rates

  • Payment may be required in advance before repair work begins

No Mediation or Dispute Handling

  • Kreativ Insight and Canda Growth Network do not mediate disputes between the Client and GoHighLevel

  • The Client is responsible for resolving any issues directly with GHL

Best Practice Recommendation

For best results, Clients are strongly encouraged to:

  • Contact Kreativ Insight or Canada Growth Network first for support requests

  • Allow Kreativ Insight to coordinate with GHL support when needed

This helps avoid unintended changes and additional costs.

10. AI Tools & Disclaimers

The Client’s GoHighLevel sub-account may include access to AI-powered tools and features, which may assist with content creation, lead engagement, automation, analytics, and other system functions.

Nature of AI Tools

The Client acknowledges and agrees that:

  • AI tools operate based on algorithms, models, and third-party services

  • AI-generated output may be inaccurate, incomplete, outdated, misleading, or inappropriate

  • AI tools do not replace human judgment, professional advice, or legal review

Client Responsibility

The Client is solely responsible for:

  • Reviewing, approving, and validating all AI-generated content before use

  • Ensuring AI-generated emails, SMS messages, workflows, and automations comply with:

    • CASL

    • PIPEDA

    • Industry regulations

    • Advertising and consumer protection laws

  • Monitoring AI-driven automations to prevent unintended behavior

No Guarantees or Liability

Kreativ Insight Consultants Inc. and Canada Growth Network (CGN) make no guarantees regarding:

  • Accuracy or reliability of AI output

  • Lead quality or conversion results

  • Proper intent recognition or automation behavior

  • Predictive workflows or AI recommendations

Kreativ Insight and Canada Growth Network are not liable for:

  • Incorrect or misleading AI-generated content

  • Missed leads or failed follow-ups

  • Automation errors or logic failures

  • AI hallucinations or unintended responses

  • Business, reputational, or financial impact resulting from AI usage

Usage-Based Billing

  • AI usage may consume Wallet funds

  • The Client is responsible for monitoring AI-related usage and costs

  • AI usage charges are non-refundable

Ethical and Responsible Use

The Client agrees not to use AI tools for:

  • Deceptive, manipulative, or misleading messaging

  • Impersonation or false representation

  • Harassment, discrimination, or harmful content

By enabling or using AI features, the Client accepts full responsibility for all outcomes arising from such use.

11. Anonymized Showcasing & Portfolio Use

Kreativ Insight Consultants Inc. may request permission to showcase anonymized examples of work created within a Client’s GoHighLevel account for educational, training, marketing, or portfolio purposes.

Permission Requirement

  • No Client materials will be reviewed, displayed, or shared without the Client’s prior written permission, provided by email

  • Permission applies only to the specific materials approved by the Client

  • Permission may be limited in scope or withdrawn at any time by written notice via email

What May Be Showcased (If Permission Is Granted)

With Client approval, Kreativ Insight may display anonymized examples of:

  • Funnels and landing pages

  • Workflows and automations

  • Snapshots and system structures

  • Campaign frameworks and templates

  • Dashboards, reports, and performance summaries

  • AI workflows or logic structures

Anonymization Standards

When permission is granted:

  • All personal, business-identifying, or sensitive data will be removed or obscured

  • Client names, logos, domains, contact data, and branding will not be displayed unless explicitly approved

  • Performance data will be presented in a generalized or illustrative format

What Will Not Be Shared

Kreativ Insight and Canada Growth Network will never share:

  • Client contact lists

  • Personally identifiable information (PII)

  • Confidential business data

  • Login credentials or access details

No Obligation

  • The Client is under no obligation to grant permission

  • Declining permission does not affect service, pricing, or support

Use Limitation

Approved examples may be used only for:

  • Demonstrations

  • Training materials

  • Internal documentation

  • Marketing or educational presentations

By granting permission, the Client confirms they have the right to authorize the use of the approved materials.

12. Limitation of Liability

The Client acknowledges that Kreativ Insight Consultants Inc. and Canada Growth Network (CGN) provide access to software and related services on an “as-is” and “as-available” basis.

No Liability for Business Outcomes

Kreativ Insight and CANADA GROWTH NETWORK are not liable for any losses, damages, or consequences arising from the use of the platform, including but not limited to:

  • Lost or missed leads

  • Lost revenue or profits

  • Failed or delayed automations

  • Campaign underperformance

  • Incomplete or inaccurate data

  • Missed follow-ups or communications

  • Wallet depletion or usage overruns

Technical & Platform Limitations

Kreativ Insight and Canada Growth Network are not responsible for issues caused by:

  • GoHighLevel platform outages or limitations

  • Third-party service outages (including Twilio, email providers, AI services, or hosting platforms)

  • Integration failures or API changes

  • DNS, domain, or email authentication issues

  • Deliverability problems

  • Changes made by GoHighLevel support

  • Third-party contractors or users added by the Client

User Error & Third-Party Actions

Kreativ Insight and Canada Growth Network are not liable for:

  • Errors caused by the Client or the Client’s team

  • Misconfigurations or deletions

  • Security breaches resulting from Client-granted access

  • Actions taken by third parties, VAs, contractors, or consultants

Indirect & Consequential Damages

To the fullest extent permitted by law, Kreativ Insight and Canada Growth Network shall not be liable for:

  • Indirect, incidental, special, consequential, or punitive damages

  • Loss of data, goodwill, reputation, or business opportunities

Liability Cap

In no event shall the total liability of Kreativ Insight Consultants Inc. and Canada Growth Network (CGN), whether in contract, tort, or otherwise, exceed the total amount paid by the Client for one (1) month of service immediately preceding the event giving rise to the claim.

Jurisdictional Limitations

Some jurisdictions do not allow limitations of liability. In such cases, liability shall be limited to the maximum extent permitted by applicable law.

13. Indemnification

The Client agrees to defend, indemnify, and hold harmless Kreativ Insight Consultants Inc., Canada Growth Network (CGN), and their officers, directors, employees, contractors, and affiliates from and against any and all claims, demands, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to the Client’s use of the platform.

Scope of Indemnification

This indemnification includes, but is not limited to, claims or actions arising from:

  • The Client’s misuse or improper use of the GoHighLevel platform

  • Violations of applicable laws or regulations, including but not limited to:

    • CASL

    • PIPEDA

    • Privacy, data protection, or consumer protection laws

  • Spam complaints, blacklistings, or deliverability penalties

  • Illegal, deceptive, or unethical activities

  • Use of purchased, scraped, or non-consensual contact lists

  • Content created, sent, or published by the Client, including AI-generated content

  • Misrepresentation, false claims, or misleading marketing

  • Actions taken by third parties granted access by the Client

  • Security breaches or data exposure caused by Client-controlled access

  • High-risk or prohibited campaigns or industries

AI-Related Indemnification

The Client specifically agrees to indemnify Kreativ Insight and Canada Growth Network from any claims arising from:

  • Reliance on AI-generated content or recommendations

  • Errors, hallucinations, or unintended outputs produced by AI tools

  • Regulatory or legal consequences related to AI-driven messaging or automation

Survival

The obligations under this Indemnification section survive termination or cancellation of the Client’s account and remain in effect regardless of the reason for termination.

Cooperation

The Client agrees to:

  • Promptly notify Kreativ Insight of any claim or potential claim

  • Cooperate fully in the defence or resolution of such claims

Kreativ Insight reserves the right to assume control of the defence at its own discretion, at the Client’s expense, where permitted by law.

14. Governing Law

This Agreement is governed exclusively by the laws of Ontario, Canada, with the courts of Ottawa, Ontario having jurisdiction.

15. Termination

Either the Client or Kreativ Insight Consultants Inc. may terminate this Agreement at any time, with or without cause, by providing written notice.

Effect of Termination

Upon termination:

  • Access to the GoHighLevel sub-account may be suspended or removed

  • All outstanding subscription fees, Wallet charges, and usage-based fees become immediately due

  • Any unpaid invoices for support, setup, marketing, repair, or project work remain payable

No Refunds Upon Termination

  • Termination does not entitle the Client to any refunds or credits

  • Wallet balances, if any, are non-refundable

  • Prepaid services are forfeited unless otherwise agreed in writing

Client Data & Access

  • The Client is responsible for exporting any data prior to termination

  • Kreativ Insight is not responsible for data loss after account access is removed

  • Continued data storage is not guaranteed after termination

Termination for Cause

Kreativ Insight may immediately terminate access without notice for:

  • Prohibited use or policy violations

  • Illegal activity

  • Trial abuse

  • Actions that place Kreativ Insight, CANADA GROWTH NETWORK, GoHighLevel, or service providers at risk

Survival of Obligations

The following sections survive termination:

  • Pricing & Adjustments

  • Wallet obligations

  • Limitation of Liability

  • Indemnification

  • Governing Law

Termination does not relieve the Client of responsibility for actions taken prior to termination.

16. PRIVACY POLICY (PIPEDA COMPLIANT)

Kreativ Insight Consultants Inc. (“Kreativ Insight”) is committed to protecting the privacy and confidentiality of Client information. This Privacy Policy explains how personal and business data is collected, used, stored, and protected in connection with the GoHighLevel (“GHL”) sub-account services.

16.1 Roles & Responsibilities

  • The Client is the Data Controller for all data uploaded, stored, or processed within their GHL account

  • GoHighLevel is the Data Processor providing the underlying software infrastructure

  • Kreativ Insight Consultants Inc. is a Service Provider with limited, permission-based access only

Kreativ Insight does not assume ownership or control of Client data.

16.2 Information Collected by Kreativ Insight

Kreativ Insight may collect and store limited information necessary to provide services, including:

  • Client name and business name

  • Email address and phone number

  • Billing and payment information

  • Account identifiers and subscription details

  • Login and usage activity related to service delivery

16.3 Data Stored Within the GHL Platform

The Client’s GHL account may contain Client-controlled data, including but not limited to:

  • Contact records and lead information

  • Calendars and appointment data

  • Email, SMS, and call logs

  • Pipeline and opportunity data

  • AI chat logs and automation activity

  • Confidential business information uploaded by the Client

All such data is entered, managed, and controlled by the Client.

16.4 Access to Client Data

Kreativ Insight does not access Client data unless:

  • Explicit written permission is provided by the Client (via email)

  • Access is required to perform paid support, setup, or troubleshooting

  • Access is required for maintenance or system integrity

  • Access is legally required

Access is limited strictly to the scope of permission granted.

16.5 Data Use & Purpose Limitation

Kreativ Insight uses collected information solely to:

  • Provide and manage services

  • Process billing and payments

  • Deliver authorized support

  • Communicate service-related updates

  • Meet legal or regulatory obligations

Kreativ Insight or  Canada Growth Network does not:

  • Sell Client data

  • Rent Client data

  • Share Client data with third parties for marketing purposes

16.6 Data Storage & Security

  • Client data is stored within GoHighLevel’s infrastructure

  • Security measures are implemented by GoHighLevel as the platform provider

  • Kreativ Insight implements reasonable administrative safeguards within its control

No system is guaranteed to be 100% secure. The Client acknowledges the inherent risks of digital data storage.

16.7 Client Responsibilities

The Client is responsible for:

  • Obtaining lawful consent for all collected data

  • Ensuring compliance with PIPEDA, CASL, and applicable privacy laws

  • Managing user access and permissions within their account

  • Maintaining secure credentials

Kreativ Insight is not responsible for privacy violations resulting from Client actions or third-party access granted by the Client.

16.8 Client Rights

Subject to applicable law, Clients may request:

  • Access to personal data held by Kreativ Insight

  • Correction of inaccurate information

  • Export of data

  • Deletion of data (where legally permissible)

16.9 Data Retention

  • Data is retained only as long as necessary to provide services or meet legal requirements

  • Upon termination, Clients are responsible for exporting their data

  • Data may be deleted or become inaccessible after account termination

16.10 Legal Disclosure

Kreativ Insight may disclose information where required by law, court order, or regulatory authority.

16.11 Privacy Policy Updates

This Privacy Policy may be updated from time to time. Material changes will be communicated by email or written notice. Continued use of the service constitutes acceptance of the updated policy.

This agreement explains the rules for using your GoHighLevel (GHL) sub-account provided by Kreativ Insight Consultants Inc. through the Canada Growth Network (CGN).

In summary:

  • You are receiving access to the GHL software only (no done-for-you services unless purchased separately)

  • You are responsible for how you collect data, send messages, run campaigns, and comply with laws such as CASL and PIPEDA

  • Some features (SMS, calls, email, AI) use a prepaid Wallet and are charged based on usage

  • Trials are limited and for evaluation only

  • Certain activities (spam, cold outreach, high-risk industries, abuse) are prohibited and may result in immediate termination

  • Kreativ Insight and Canada Growth Network are not responsible for your actions, third-party access, AI output, or changes made by GoHighLevel support

  • Liability is limited, refunds are discretionary, and either party may cancel at any time

By starting a trial or using the service, you agree to these terms and accept full responsibility for how the platform is used.
